How New York Courts Evaluate Fathers’ Rights Cases

New York courts apply the best interests of the child standard in every custody and visitation determination. Neither parent starts with a presumed advantage based on gender. What matters is the totality of the circumstances surrounding the child’s life and each parent’s relationship with them.

Judges may consider each parent’s involvement in the child’s daily routines, school, and medical care; the stability of each home environment; each parent’s work schedule and ability to meet the child’s needs; and each parent’s willingness to support the child’s relationship with the other parent. A father who has been actively involved in caregiving and can demonstrate that history stands on equal legal footing when custody is determined.

Legal custody and physical custody are distinct concepts. Legal custody covers decision-making authority over major life decisions, including education, health care, and religious upbringing. Physical custody refers to where the child primarily lives. Depending on the facts of the case, a father may be awarded joint legal custody, primary physical custody, or a substantial parenting time arrangement.

Establishing Paternity for Unmarried Fathers in Brooklyn

When parents are married, New York law presumes the husband is the child’s legal father at birth. For unmarried fathers, paternity must be established before Brooklyn Family Court can issue a custody or visitation order. Without legal paternity, a father has no enforceable parental rights, regardless of his relationship with the child.

Paternity can be established voluntarily by signing an Acknowledgment of Paternity, a form that can be completed at the hospital after birth, at a child support office, at the birth registrar’s office, or at Family Court. Parental alienation refers to a pattern in which one parent systematically undermines the child’s relationship with the other. New York courts may consider evidence of parental alienation in custody determinations, and it can be a factor in modifying an existing custody arrangement.
