Parental Relocation & Fathers’ Rights in New York

When a custodial parent wants to move with a child, that proposed relocation can fundamentally alter a father’s access and involvement. In New York, a custodial parent must obtain either the other parent’s consent or court approval before relocating with a child when the move would substantially affect the non-custodial parent’s access.

Courts evaluate relocation requests by weighing the reason for the move, the impact on the child’s relationship with the non-relocating parent, and whether a revised visitation schedule could reasonably preserve that relationship. A father has standing to oppose the proposed move and, if the court approves relocation, to seek a modification of the custody arrangement.
