Orders of Protection & Family Offense Proceedings
A Family Offense Petition asks Family Court to consider alleged misconduct between people who meet New York’s relationship requirements. Qualifying relationships may include spouses, former spouses, co-parents, relatives, and people who are or were in an intimate relationship.
The petition may request an Order of Protection imposing conditions intended to restrict specified conduct. Depending on the circumstances and the court’s decision, the order may address contact, stay-away requirements, children, firearm surrender, or other behavior.
