What Problems Can Arise With Custody Arrangements?

Unfortunately, it issues involving child custody can be some of the most difficult to find a solution to during the divorce process. This is a highly emotional area of the law and if not handled correctly, it can result in a bitterly contested courtroom battle. Beyond that, even when custody is determined, issues can arise that can cause serious legal problems for the custodial and even the noncustodial parent.

Some common custody problems that can arise include, but are not limited to, the following:

• Parental Interference - In some cases a parent may not agree with the arrangement that is provided. When this occurs, some parents may begin to interfere with custody or visitation arrangements. This could be stopping child support payments to force a parent to give the noncustodial parent more time with a child, not arriving at specified times and places for the trade-off of the child or even bribing the child to ask for more time to be spent with them.
• Moving Out of State - People move all the time - no matter whether for a job, relationships or other reasons. Should the custodial parent relocate, it can cause hardships on any custody arrangement. When this occurs, it can be financially impossible for a noncustodial parent to continue having continuous visitation with the child and can lead to a courtroom battle to contest the move.
• Child Abduction - Unfortunately, in some cases, it can go to extremes and parents can even attempt to abduct the child as a way to keep in contact. When this occurs, the other parent has legal rights to press criminal charges which may involve local and state police and even the FBI.
